FRP Advisory appointed Liquidators to Cotswold Geotechnical (Holdings) Ltd

Charles Turner and Gareth Morris, partners at specialist restructuring, recovery and insolvency firm, FRP Advisory LLP, were appointed on 21 June 2011 as Joint Liquidators to Gloucestershire based Cotswold Geotechnical (Holdings) Ltd, which lost its appeal against a conviction for corporate manslaughter last month.
Cotswold Geotechnical (Holdings) Ltd was convicted of corporate manslaughter by Winchester Crown Court on 15 February 2011 after a geologist, Alexander Wright, was killed when the 3.5m trial pit he was working in collapsed. The company was found guilty of failing to ensure the safety of Mr Wright in the first prosecution case under the Corporate Manslaughter and Corporate Homicide Act 2007.
The company was fined £385,000, to be paid over 10 years. The uncertainty surrounding the company’s future following the prosecution, the effects of the recession on the construction industry and the worsening health of the company’s sole director, all adversely affected the company’s trading performance.
Commenting, Charles Turner said: “As a consequence of a tragic incident, the damage to the company that resulted from the subsequent legal proceedings and a fine which rendered the company substantially insolvent, liquidation has become inevitable. There is no realistic prospect of the company being able to trade out of its difficulties, to pay creditors and the fine. Sadly, this modest company has little choice other than to cease trading and enter into a Creditors Voluntary Liquidation.”
