FRP appointed as party expert in a breach of contract case

FRP’s Forensic Services team successfully conducted a calculation of loss in support of the clients claim.

Background

Forensic Services Partner, Fiona Hotston Moore, was instructed as party expert in relation to a contractual dispute arising out of a contract between one party to provide stone materials to another. The case was listed in the London Court of International Arbitration, and FRP was instructed to provide an opinion on the loss incurred by the supplier as a result of the breaches of contract.

Action

Our Forensic Services team prepared a report which presented a calculation of the losses to the company on a number of alternative assumptions. Partner, Fiona Hotston Moore then attended the London Court of International Arbitration and was cross examined on FRP’s report, and the report of the expert instructed by the other party.

Outcome

The Tribunal concluded that damages were due to our client and the calculations prepared by FRP were largely adopted in the Tribunal calculations. The analysis of the other expert was not adopted as it was determined not to reflect the contractual terms.
